In consideration of BOK Play Cafe Inc., at 259 Danforth Ave, Toronto, Ontario, M4K 1N2 (“Bok”), allowing any and all children (each a “Child” and together the “Children”) who enter BOK’s indoor playground facility (the “facility”), under my direct or indirect supervision, to use the facility, I, hereby on behalf of myself, my Child/Children, my Children’s heirs, executors, administrators, or anyone who might claim on their behalf, agree as follows:

• I represent and warrant that I am the parent or legal guardian of the below listed Child/Children and I agree that I will be fully responsible for the supervision of the Child/Children.
• By entering the facility, I acknowledge and I am fully aware of the inherent risks present in an indoor play environment (including, without limitation, damage to personal property, personal injury or death) and that the equipment in the facility and the nature of its use can be dangerous and may result in serious injury to myself and/or my Child/Children.
• I hereby knowingly and voluntarily assume and accept all risks, including all presently unknown or unforeseeable risks, and assume all responsibility of risks to myself, my Child/Children, my personal property and the personal property of my Child/Children upon signing this Waiver.
• I represent and warrant that I have read the BOK Indoor Play Space Rules and Party Rules (the “Rules”) attached hereto as Schedule “A”, which form part of this Waiver. I agree to, and shall ensure my Child/Children use the facility only in accordance with the Rules. I acknowledge that failure to abide by the Rules or to use the equipment in a safe and appropriate manner may, at the sole discretion of BOK, result in my and/or my Child’s/Children’s removal from the facility.
• I understand and agree that BOK, its shareholders, officers, directors, employees, management, contractors, agents or other representatives (the “Representatives'') shall not be liable for any injury, damage or loss that I or my Child/Children may suffer as a result of using the facility. I understand and agree that BOK and its representatives are not responsible for the supervision of my Child/Children and shall not be held liable for any reason whatsoever for failing to supervise my Child/Children, including without limitation child disappearance.
• I hereby release, waive and forever discharge BOK and its Representatives from any and all liability, claims, demands, losses, or damages, however caused, whether related to property damage, theft, and/or personal injury (including death), and whether based on tort, intentional act, strict liability, negligence, and/or negligent rescue, that I or my Child/Children may suffer as a result of my Child/Children using the facility, including as a result of the negligence of BOK or its Representatives. I will indemnify, save and hold harmless each of BOK and its Representatives from any and all claims, expenses, legal fees, losses, liabilities, damages, or costs which relate to, or arise from, this Waiver, to the maximum extent permitted by law.
• As my Child/Children is a minor, I the undersigned, parent or guardian, hereby give permission for BOK to authorize emergency medical treatment as may be deemed necessary for the Child/Children named below while participating in activities at the facility. The undersigned hereby releases, discharges and agrees to indemnify and save harmless BOK from all liability, claims, demands, losses or damages on the Child’s/Children’s account caused or alleged to have been caused in whole or in part by any medical treatment (whether negligent or otherwise) or any failure to provide medical treatment, and further agree to indemnify, save and hold harmless BOK and its Representatives from any liability whatsoever as a result of any such claims.
• I represent and warrant that my Child/Children is/are in good physical condition and physically able to play in the facility and that my Child/Children is/are old enough to participate.
• I acknowledge and agree that my execution of this Waiver on the initial or any visit, for one of my Children, will and does authorize BOK to enter this Waiver into its database and use it as a continuous, multi-use waiver for my Childs/Children’s ongoing entry to play in the facility and use it as a Waiver executed for my other Child/Children. I hereby expressly authorize BOK to use this Waiver as a multi-use waiver until such time as I revoke it in writing.
• I agree and acknowledge that the facility is NOT a NUT FREE ENVIRONMENT, and that BOK offers products containing NUTS that are not individually packaged. For your safety and the safety of your kids, please be aware that products at the facility may contain or come in contact with PEANUTS, TREE NUTS or OTHER ALLERGENS.
• If any provision, clause or phrase of this Waiver is found to be unenforceable or invalid, that portion shall be severed from this Waiver.
• I acknowledge that: (i) I have been given adequate opportunity to read and understand this Waiver and (ii) this Waiver was not presented to me at the last minute.
• I have read this Waiver, I understand it, and I agree to be bound by it. By checking the box, I hereby certify that I am the parent or guardian of the below listed Child or Children.

CONSENT

It is our policy to notify a parent when a child is ill or needs medical attention. Occasionally, we cannot contact a parent and we need to get immediate help for the child. Our procedure is to take the child to the nearest Children's Hospital, Michael Garron Hospital.

In consideration of our other members, please keep sick children at home. Children should not return to BOK Play Cafe until symptoms have been absent for at least 24 hours.

BOK is not responsible for any lost or stolen items.

Due to fire safety regulations, no strollers are allowed inside.

BOK is NOT a NUT FREE ENVIRONMENT, we offer products that are individually packaged and could contain nuts. For your safety and the safety of your kids , please be aware that products at this location may contain or come in contact with PEANUTS, TREE NUTS or OTHER ALLERGENS.

BOK Staff are fully vaccinated against COVID 19, trained in First Aid/CPR, and have up to date Vulnerable Sector Background checks.

BOK Play Cafe Inc. will be from time to time taking photos of students during their activities within the premises and field trips. In this regard, we seek your consent for the publishing or use of photos which your child may be included.

The photos will be used for bulletin boards, marketing or advertising, and/or marketing updates posted via the facebook page, website, and/or within the walls of the play cafe premises.

Should you decide to take back your authorization later on, you may do so by writing to us. For protection of the privacy of the child, we guarantee that names will not be included.

If you do not want to have your child photographed, please do not hesitate to indicate this in the section below. As well, if you do object, please ensure that your child is aware of this.

Party Rules

$200 + tax non-refundable deposit to hold the date/time.

Full payment is due 3 weeks in advance.

Less than 3 weeks’ notice, cancellations will be given reimbursement by BOK credit. More than 3 weeks’ notice will be refunded with a processing fee charge (not the deposit).

If a party is cancelled due to Public Health Orders, the deposit can be kept on credit or transferred to a gift card; refund requests can be processed subject to a $50 processing fee.

Hosts can enter maximum 15 mins prior to the party start time to decorate/set up.

Party Guests are not admitted into the space until the party start time.

Party host is required to fill out waiver (see below) and return signed 5 days prior to party.

All guests must wear socks, no exceptions.

Guest maximum capacity is 50 people.

Children under 1 year of age are excluded from the total count of kids attending the party.

Outside food and drinks are permitted.

Only cakes and desserts can be stored in our refrigerator if space is available.

Host family has maximum 15 minutes post event to collect personal items and exit the space, otherwise we will charge $75 CAD.

Beer & Wine is allowed with a Special Occasion Permit from the LCBO (Send us the permit 2 weeks prior to your party date).

Our package includes cutlery, napkins, plates and cake cutting knife if applicable.

Standard set up and clean up provided by BOK.

The party host is to assist with set up and clean up.

Party entertainers such as face painters, superheroes, princesses and balloon twisters are allowed, please let us know before the event date.

Any decor, cakes etc must be brought with host no more than 15 minutes prior to party start time.

Only painters tape is permitted when hanging decorations.

Any damages caused to the BOK facilities will fixed by BOK and charged to the client.

An extra charge of $150 per additional hour (time permitting) will be applied.
